General Terms and Conditions (GTC)

1. Scope

1.1 These General Terms and Conditions (GTC) govern the use of the platform 'Credura' and all contractual relationships with Credura GmbH (hereinafter collectively referred to as 'Credura').

1.2 By registering on the platform or using Credura's services, you agree to these GTC in their current version.

2. Services of Credura

2.1 Credura offers a platform for managing and analysing insurance policies as well as displaying relevant information.

2.2 All data and content provided via Credura is for informational purposes only and does not constitute legal, tax or financial advice.

2.3 Credura PRO customers participate in the compensation received from insurance companies for their insurance contracts. The payout of compensation is based on the cancellation conditions of the insurance company and is determined by Credura. Upon cancellation of the PRO subscription, any claim to unpaid compensation is forfeited.

3. Disclaimer for data and information

3.1 Credura does not guarantee the accuracy, completeness, timeliness or availability of data, information or content provided on the platform. Use of the information provided is at your own risk.

3.2 Credura does not guarantee that the platform is error-free, uninterrupted or free from viruses or other harmful components. Any liability for damages resulting from the use or inability to use the platform is expressly excluded.

3.3 All content displayed is for informational purposes only and does not constitute a reliable basis for financial, legal or other decisions. Users are expressly advised that they act at their own responsibility and should seek professional advice if needed.

3.4 Credura assumes no liability for damages caused by incorrect data entry by users. Users are solely responsible for updating or ensuring the accuracy of the information they provide.

3.5 Credura is not liable for damages arising from interactions with third parties, including but not limited to insurance companies, service providers or other platform users.

3.6 Any warranty claims regarding the use of the platform or its content are expressly excluded to the extent permitted by law.

3.7 Credura is in no case liable for consequential damages, indirect damages or lost profits.

3.8 Credura's liability is limited, to the extent permitted by law, to CHF 100, regardless of the number or type of claims.

4. Limitation of liability

4.1 Credura is only liable for damages caused by intent or gross negligence. For slight negligence, Credura is only liable for the breach of essential contractual obligations (cardinal obligations).

4.2 In no case is Credura liable for indirect damages, consequential damages or lost profits.

5. User obligations

5.1 Users undertake to provide all data they submit correctly and truthfully.

5.2 Misuse of the platform, such as providing false or misleading data, is prohibited.

6. Data protection

6.1 The processing of personal data is carried out in accordance with Credura's privacy policy.

7. Changes to the GTC

7.1 Credura reserves the right to change these GTC at any time. Users will be informed of changes in a timely manner. The amended GTC are deemed accepted if no objection is raised within 14 days of notification.

8. Applicable law

8.1 Swiss law applies. The exclusive place of jurisdiction is the registered office of Credura.
